The European Commission's Great TTIP Betrayal

When the European Commission was laying the foundations for the Transatlantic Trade and Investment Partnership - TTIP, also known as TAFTA by analogy with NAFTA - it was doubtless hoping that the public would ignore it, just as it had ignored countless other boring trade agreements. But of course TTIP is not principally a trade agreement: it aims to go far beyond "merely" liberalising trade by attacking "behind the border" barriers.

These "non-tariff barriers" - NTBs - are what you and I call health and safety regulations, environmental protection, labour laws etc. They are all things that make life a more pleasant place - especially in Europe, where they are particularly strong; but they are also things that decrease the profits of companies that must obey them. TTIP is about removing as many of these as possible, so as to boost corporate profits.

Of course, that's not how the European Commission can frame things. Indeed, after the public began to wake up to what TTIP really meant, the commissioner responsible for leading the TTIP negotiations, Karel De Gucht, was forced to make high-profile statements denying that the agreement would lower standards:

Let me be clear on this very important point: we are not lowering standards in TTIP. Our standards on consumer protection, on the environment, on data protection and on food are not up for negotiation. There is no “give and take” on standards in TTIP.

Simple logic tells us that this can't possibly be true. If two completely different regulatory systems are to be brought together - the avowed aim of TTIP - there are only three possibilities. Either the side with the higher standards levels down; the side with the lower standards levels up; or there is mutual recognition of each other's standards. The US has clearly stated that it is not prepared to level up - it won't accept EU bans on chlorine-washed chickens, hormone beef or GMOs.


Mutual recognition, although apparently different, is in fact identical to levelling down: if both regulations are acceptable, manufacturers working to the higher set will be at a disadvantage commercially. They will therefore either relocate their factories to the country with the lower standards, which are cheaper to implement, or lobby for the higher standards to be levelled down, threatening either to leave the country, or shut down. Politicians always give in to this kind of blackmail, so EU standards would inevitably be lowered to those of the US as a result of mutual recognition.


But it has become increasingly clear that there is another way for the European Commission to circumvent its own promises that TTIP will not lower standards. The trick here is that the European Commission will lower standards *before* TTIP; so technically speaking it is not TTIP that brings about that dilution - it occurred "independently". Thus the Commission will be able to put its hand on its heart and swear blind that it kept its word not to sell out EU standards in TTIP, while at the same time changing the regulatory context in such a way that the US will be able to export things that are currently banned by strict EU legislations.


We're seeing more and more examples of this. Here, for example, is how new GMO regulations will allow US companies to bring in GM food:

Genetically modified crops could be grown in the UK from next year after the EU ministers relaxed laws on the controversial farming method.
Maize that has been engineered to resist weedkiller is the first to be approved but all commercial GM crops will not be given the green light for another 10 years.
Owen Patterson, the Environment Secretary, has long supported the introduction of GM crops in the UK and voted in favour of the changes on Thursday.
He said: “This is a real step forward in unblocking the dysfunctional EU process for approving GM crops, which is currently letting down our farmers and stopping scientific development.


Here's how the EU's Fuel Quality Directive, designed to discourage the use of highly-polluting carbon fuels, is being drastically weakened [.pdf]:

Since its inception in 2009, the Fuel Quality Directive (FQD), a European Union regulation aimed at reducing the climate impact of transport fuels, has been attacked by powerful lobby interests that do not want the EU to take action to curtail the use of particularly greenhouse gas intensive fossil fuels.
...
these attempts to weaken this landmark climate policy seem to have been successful. If recent media reports are correct, the European Commission has decided to significantly weaken the FQD and align its regulatory standards with the wishes of the oil industry, the US trade negotiators [for TTIP] and the Canadian government. Compared to a previous proposal from 2011, it would be considerably less effective in cleaning up Europe’s transport fuels and preventing the most climate polluting fuels, including tar sands, from entering Europe.

Most recently, we have learned that the European Commission is preparing to allow endocrine disruptors in pesticides - another key demand from the US side in TTIP. Unfortunately, the source for this information, Inside US Trade, is behind a paywall, so I can't give a link, but will just quote a couple of key passages:

One of the options proposed by the commission in a June 17 "roadmap" is to shift from the current EU approach of banning the use of all endocrine disruptors in pesticides toward a model that could allow them to be used as long as certain steps are taken to mitigate the risk. 

This risk assessment-based model is favored by the U.S. and EU pesticide industries and is the approach employed under the U.S. Environmental Protection Agency's "Endocrine Disruptor Screening Program." Such a model seeks to evaluate both whether a hazard exists and if it can be mitigated by limiting exposure, in order to allow the marketing of an otherwise dangerous product.


As you can see, this amounts to abandoning the EU's Precautionary Principle, and adopting the completely different risk-based approach of the US. Aside from the fact that this shows that the European Commission's promises that standards would not fall, that the EU would not be forced to adopt US approaches, and that public health in Europe would always be safeguarded, were worthless, this also disregards the EU's Treaty of Lisbon, which explicitly states:



Union policy on the environment shall aim at a high level of protection taking into account the diversity of situations in the various regions of the Union. It shall be based on the precautionary principle and on the principles that preventive action should be taken, that environmental damage should as a priority be rectified at source and that the polluter should pay.


What's particularly interesting about the latest move by the European Commission is that the industry sources in the article quoted above point out that it represents a move to a "science-based" approach, something they have been demanding (note, too, that Owen Paterson also spoke of "scientific development" in the passage quoted above.) 

This is part of consistent campaign to paint the Precautionary Principle as "unscientific". In fact, this reframing is precisely what I predicted would happen a year ago. The key point is that "science" in the abstract does not exist: there is a continuum of good science and bad science - where the latter often includes experiments carried out by corporate scientists who miraculously produce results that match their paymaster's desires.



It's not just me saying this. Yesterday the following article appeared in the Guardian on the subject of pesticide research - the area that the European Commission wants to overhaul radically, moving towards a "science-based" approach:

Criticial future research on the plight of bees risks being tainted by corporate funding, according to a report from MPs published on Monday. Pollinators play a vital role in fertilising three-quarters of all food crops but have declined due to loss of habitat, disease and pesticide use. New scientific research forms a key part of the government’s plan to boost pollinators but will be funded by pesticide manufacturers.


That is, as I pointed out, when companies pay for research, they tend to get the answers they want.



When it comes to research on pesticides, the Department of Environment, Food and Rural Affairs (Defra) is content to let the manufacturers fund the work,” said EAC chair Joan Walley. “This testifies to a loss of environmental protection capacity in the department responsible for it. If the research is to command public confidence, independent controls need to be maintained at every step. Unlike other research funded by pesticide companies, these studies also need to be peer-reviewed and published in full”.



This again is something that I advocated last year. If companies want us to take their results seriously - and in principle I don't have problem with that, provide the science is sound and independent - then they must publish their findings in peer-reviewed journals and, crucially, publish *all* of their results as open data, for anyone to check and explore further. If they won't do that, we will know that they have something to hide.



In the meanwhile, expect the European Commission to start invoking "science-based" approaches to policy more and more, and that these strangely always mean that the European Union should lower its standards to those of the US, which already uses this "tainted" approach.



But however the Commission wants to package this massive shift, and whatever lipstick it puts on this particular pig (sorry, pigs, nothing personal), this is a fundamental betrayal at the very deepest level. It is truly disgraceful - not to mention ungrateful - that at every turn the European Commission seems to prefer to serve US corporations rather than the European public that pays the Commissioners' not-inconsiderable salaries. It's another reason why the whole of TTIP - not just the already terminal ISDS - must be rejected.

TTIP's "Science-based" Assault on Democracy Begins

Last month I predicted that one of the main tropes that would be used in the TAFTA/TTIP negotiations would by that of "science-based" policy. As I pointed out then, this is a trick, since the "science" actually consists of work by scientists working for big companies that want to push their products with minimal health and safety oversight by independent laboratories.

A great article from Public Citizen shows that this line of attack has already been deployed in a series of submissions hammering home the idea to both the US and EU delegations:

Food Safety
  • “Science-based risk assessment, as the foundation for regulatory decisions, must not be overruled by an incorrect (and politically driven) application of the precautionary principle, as currently applied by the EU (Croplife America, a lobbying group of U.S. pesticide corporations that includes genetically-modified-organism (GMO) giant Monsanto)
  • Finally, the EU’s political approach in regulating crops enhanced with traits achieved through modern biotechnology procedures is a concern to U.S. wheat producers. The EU biotechnology approval process is slow and often influenced more by politics than science, creating uncertainty and deterring new investment in wheat research… Science and market preferences, not politics, should be the determinants. (U.S. Wheat Associates)
  • The current 'asynchronous approval' situation is caused by many factors, including risk assessment guidelines that are not aligned and increasing politically-motivated delays in product approvals. (National Grain & Feed Association and North American Export Grain Association, lobbying groups comprised of the largest U.S. agribusinesses, such as Cargill and Archer Daniels Midland)
  • International trade rules fully support trade in products of biotechnology for planting, processing and marketing, subject to science-based regulation… Politically motivated bans or moratoria by WTO member states are not consistent with members’ WTO obligations. (National Corn Growers Association)
  • The implementation of production standards based on politics or popular thought instead of science will do nothing more than eliminate family operations and drive up costs to consumers. (National Cattlemen's Beef Association, a factory-farm-supporting lobbying group for the beef industry)
  • What is deeply concerning about the EU’s overall approach to SPS [sanitary and phytosanitary] issues, however, is that its political body is frequently given the ability to override the EU’s own scientific authority’s findings to instead establish restrictions on products based typically on animal welfare or consumer preferences. (National Milk Producers Federation & U.S. Dairy Export Council)
 Product Safety

  • Significant barriers to further alignment, namely politics and differences in regulatory approach, remain on both sides of the Atlantic. Our experience has also shown that politics and differences in regulatory philosophy are fundamentally the root causes for differences in toy safety standards… Frequently, standards that are stricter than their international counterparts are promulgated due to political influence or the (often unstated) desire to erect technical barriers to trade, and not predicated by science or risk factors. (Toy Industry Association and Toy Industries of Europe)
  • We would like to highlight the fact that these regulatory differences are often politically motivated… We regret that the differences in regulations in the EU and US are often caused by the result of politics rather than a different approach to ensuring safety. (Toy Industries of Europe)
  • Such discussions need to take place between technical, not political or administrative, entities and need to make business sense for the organizations involved. (ASME, a lobbying group for engineers -- the first U.S. "non-profit" entity convicted for violating antitrust laws)
Some of the statements there are truly incredible - for example, the idea that animal  welfare or consumer preferences have no place in a country's trade policy, or that standards "stricter than their international counterparts" are somehow bad, and should be forbidden (isn't that what we should be striving for - doing better than the average?)  The latter also confirms what I've noted elsewhere: that the only way TTIP can "succeed" on its own terms is if all health and safety standards are levelled *downwards*, to the detriment of the public.

But the most significant point that emerges from the above is the false opposition between that "science-based" method and the "politically-motivated" approach.  As rightly pointed out by Public Citizen:

the "political" bodies the corporations fear are the democratically elected representatives of the people.  

Without realising it, the corporations are revealing their profound contempt for democracy, and for the right of citizens to choose the laws that govern them.  Instead, the huge multi-nationals are asserting the primacy of profit - and of their right to over-rule local laws.  I've warned about this previously, specifically in the case of Monsanto, but it's still frightening to see the naked expression by companies of their desire to see law trumped by lucre.

It seems extraordinary that in the area of copyright it is only recently that people have started to consider the evidence before formulating policy. Even now, there is still resistance to this idea in some quarters. Elsewhere, though, there is a growing recognition that policy-makers must have access to the data they need when considering how to achieve given goals.

Stop the UK Badger Cull: Letter to My MP

I had been vaguely aware that the proposed cull of badgers in the UK was controversial, but had not fully realised that the evidence against it was so overwhelming.  That was confirmed by this letter in the Observer today, with some of the top scientists in the country coming out against it, and this short video, which usefully explains the issues and why the cull will make things worse.

As a result, I have been moved to send a missive to my MP, using the wonderful WriteToThem service.  Here's what I've written:

I am writing to you to express my deep concern over government plans to cull badgers.

As a Londoner, this is not a topic I normally concern myself with. I naturally have no objection to farmers seeking to minimise losses to their herds from serious diseases such as TB. However, as the letter in today's Observer (at http://www.guardian.co.uk/theobserver/2012/oct/14/letters-observer) from 30 leading professors with expertise in this area points out, a badger cull is likely to make the situation worse, not better.

The reasons why are well explained in this video (http://justdosomething.org.uk/badgersmatter), which includes a contribution from Sir David Attenborough among others: shooting badgers will lead to a dispersion of them from their current locations. If any of them are infected with TB, they will carry that with them to new areas. A far better solution would seem to be the use of vaccination of badgers against TB, something that is apparently already efficacious, but which could benefit from funding to refine.

Given the overwhelming – indeed, near-unanimous – view that the badger cull will not only fail to achieve its goals, but will actually exacerbate the situation, I am disturbed that the Government is nonetheless planning to proceed with it. It is crucially important that policy be evidence-based, not the result of pandering to groups that have apparently taken an unscientific view for reasons best known to themselves. I would be grateful if you could convey my concerns to the relevant minister, along with a request that the cull be suspended and more efficient and humane methods deployed instead.

Microsoft's Subtle Knife Through the Heart of EU Software Industry

One of the striking changes at Microsoft over the last twenty years is how savvy it has become in terms of lobbying and influencing political opinion. There was a time when, like most serious tech companies, it regarded this kind of sneaky activity as beneath it - something that only tobacco companies would stoop to. No more; today, it bombards everyone and anyone with a constant stream of carefully-crafted policy papers and posts designed to achieve its goals.

Opening Our Eyes to the Tilted Playing-Field

One of the subtlest ways of gaming the system is to hack the system before you even play - for example, by building in a bias that means your particular approach is given a natural advantage. That this goes on, is nothing new; that it's happened at the heart of the European Union is profoundly disturbing. Here's the summary of what's now been discovered:

These findings suggest that BAT [British American Tobacco] and its corporate allies have fundamentally altered the way in which EU policy is made by ensuring that all significant EU policy decisions have to be assessed using a business-orientated IA [Impact assessment]. As the authors note, this situation increases the likelihood that the EU will produce policies that favor big business rather than the health of its citizens. Furthermore, these findings suggest that by establishing a network of other industries to help in lobbying for EU Treaty changes, BAT was able to distance itself from the push to establish a business-orientated IA to the extent that Commission officials were unaware of the involvement of the tobacco industry in campaigns for IA. Thus, in future, to safeguard public health, policymakers and public-health groups must pay more attention to corporate efforts to shape decision-making processes. In addition, public-health groups must take account of the ways in which IA can be used to undermine as well as support effective public-health policies and they must collaborate more closely in their efforts to ensure effective national and international policy.

A number of lessons need to be learned from this.

First, that if you want a system to produce fair results, you need to ensure that its framing is fair. Secondly, full transparency is imperative, especially about the relationships between those who are lobbying for changes to a system. Basically, you just can't have too much openness when it comes to setting key policy like Impact assessment.

This is an incredibly important - and impressive - paper, with huge implications for many areas. One that springs to mind is that of environmental protection. Given that the framing of Impact assessments is biased in favour of business and financial issues, it's not hard to see that other viewpoints - for example of examining the implications for animal and plant life, or of the various commons impacted - will receive pretty short shrift. It's also an argument for the economics of externalities to be developed more so that they can be brought into the equation when such one-side reviews are being conducted.

Good news: Irving Wladawsky-Berger, the person who essentially steered IBM toward GNU/Linux - with huge knock-on effects - has joined one of that nice Mr Obama's policy groups:


Technology, Innovation & Government Reform

The Technology, Innovation & Government Reform Policy Working Group will help prepare the incoming Administration to implement the Innovation Agenda, which includes a range of proposals to create a 21st century government that is more open and effective; leverages technology to grow the economy, create jobs, and solve our country’s most pressing problems; respects the integrity of and renews our commitment to science; and catalyzes active citizenship and partnerships in shared governance with civil society institutions. The Working Group is organized into four sub-teams: (1) Innovation and Government, (2) Innovation and National Priorities, (3) Innovation and Science, and (4) Innovation and Civil Society.

As well as interviewing him for Rebel Code, where he graciously spent some time explaining things when he was a busy man, I also interviewed him for the Guardian. That piece provides a lot of hints at just how wide-ranging his interests are. (Via eightbar.)

Croats Have a Go at...OSS Policy

It seems that Croatia has joined the Euro-club of OSS enthusiasts. At least that's what I'm told. I really must get around to learning Serbo-Croat....
