Doing the Business: a novel about the office

Back in November, during the UK's second lockdown, I put online my novel about travel and tourism – "Egyptian Romance" – since it was the closest I or most people would get to visiting these or any other places.  As we enter the third UK lockdown, I thought I'd post the novel I wrote afterwards, about another activity that is now similarly rare and exotic: working in an office.

"Doing the Business" is about the particular social dynamics of the office, specifically within a magazine publishing company.  It is even more archaeological, because it describes how magazines were produced before computers.  But its main themes are gloire and amour, which I hope will provide a little distraction, just as they have down the centuries...

By stopping people from reading your stories unless they have a subscription, you diminish your influence in the media world, drastically reduce the number of readers and thus make it much harder to generate revenue from them. Here's A Taste Of What Publishers Will Do If First Sale Rights For Foreign Goods Disappear

As Techdirt reported a few months back, the Supreme Court Justices seem rightly concerned about the "parade of horribles" -- things that would happen if the decision in the Wiley v. Kirtsaeng copyright case over whether or not you have the right to resell a foreign-made product you bought were applied generally. In the oral arguments, the line of Wiley's lawyer was essentially: nothing bad will happen, because copyright holders would never dream of using the decision to make outrageous demands.

Top Pirate Party Member Has DMCA Takedown Notices Issued In Her Name

Julia Schramm is one of the rising stars of the German Pirate Party: in April, when she was just 27 years old, she was elected to the national party's executive committee. No surprise, then, that she is against copyright: in a podcast she described intellectual property as "disgusting" (original in German.) More surprising is that, despite this, she signed a contract with Knaus-Verlag, part of the publishing giant Random House group, to write a book. Perhaps the $130,000 advance had something to do with it.

Norwegian Court Rules Blog Posts Are Not 'Made Public'

It's something of a truism that the courts take time to catch up with technology, especially in the fast-moving world of the Internet, but Thomas Steen points us to a recent court decision in Norway where the gulf between law and life is particularly wide. The case concerns a blogger called Eivind Berge who was arrested recently on account of some statements on his blog that allegedly "glorified and encouraged the killing of policemen" as a report on the Dagbladet newspaper site puts it (Norwegian original.) It would be something of an understatement to say that the world of public libraries is undergoing rapid change at the moment. On the one hand, the rise of open access means that people are increasingly able to find information online that was formerly held in serried ranks of volumes stored on library stacks. Another Reason Why DRM Is Bad -- For Publishers

As a way of fighting unauthorized sharing of digital files, DRM is particularly stupid. It not only doesn't work -- DRM is always broken, and DRM-less versions quickly produced -- it also makes the official versions less valuable than the pirated ones, since they are less convenient to use in multiple ways. As a result, DRM actually makes piracy more attractive, which is probably why most of the music industry eventually decided to drop it.

Publishing 2.0: Content Is Marketing, Profits Come From The Packaging

Publishers find themselves confronted by a difficult dilemma at the moment. On the one hand, they might want e-books to succeed, because digital devices represent a huge new market to which they can sell their back catalogs. On the other, they might want them to fail, because e-books will cannibalize sales of traditional books, and it's not yet clear how low the price of e-books will have to go in order to avoid the kind of piracy problems the recording industry exacerbated through persistent overcharging.

If Libraries Didn't Exist, Would Publishers Be Trying To Kill Book Lending?

Against the background of today's war on sharing, exemplified by SOPA and PIPA, traditional libraries underline an inconvenient truth: allowing people to share things – principally books in the case of libraries – does not lead to the collapse of the industry trying to sell those same things. E-Publishing The Chinese Way: Very Fast And Very Cheap

Increasingly, publishers are joining the music and film industries in bemoaning the effects of piracy on the sales of digital products – and some are even starting to sue people for alleged copyright infringement (because that has worked so well elsewhere.) Perhaps they should take a look at what is happening in China: instead of whining about e-book sales "lost" to piracy, publishers there have come up with a business model that embraces the possibilities of the Internet

Does Amazon Want to Monopolize The Entire Publishing Chain?

The launch of Amazon's Kindle Fire at a price well below expectations has naturally focused people's attention on the e-book side of Amazon's operations, and the likely effect of the extended Kindle family on other publishers trying to go digital. But something else is happening at the other end of the publishing chain that could well disrupt the industry just as much, if not more: Amazon is becoming a major publisher in its own right.

German Publishers Want More Monopoly Rights

Here's an almost unbelievable piece about what's happening in Germany right now:

It looks as if publishers might really be lobbying for obtaining a new exclusive right conferring the power to monopolise speech e.g. by assigning a right to re-use a particular wording in the headline of a news article anywhere else without the permission of the rights holder. According to the drafts circulating in the internet, permission shall be obtainable exclusively by closing an agreement with a new collecting society which will be founded after the drafts have matured into law. Depending on the particulars, new levies might come up for each and every user of a PC, at least if the computer is used in a company for commercial purposes.

Well, obtaining monopoly protection for sentences and even parts of sentences in a natural language appears to be some kind of very strong meat. This would mean that publishers can control the wording of news messages. This comes crucially close to private control on the dissemination of facts.

But guess what? Someone thinks that German publishers aren't asking for *enough*, as the same article explains:

Mr Castendyk concludes that even if the envisaged auxiliary copyright protection for newspaper language enters into law, the resulting additional revenue streams probably would be insufficient to rescue the publishing companies. He then goes a step further and postulates that publishing companies enjoy a quasi-constitutional guarantee due to their role in the society insofar the state has the obligation to maintain the conditions for their existence forever.

Utilising the leveraging effect of this postulated quasi-constitutional guarantee, Castendyk demands to amend cartel law in order to enable a global 'pooling' of all exclusive rights of all newspaper publishers in Germany in order to block any attempt to defect from the paywall cartell by single competitor as discussed above.

This is a beautiful demonstration of a flaw at the heart of copyright: whenever an existing business model based around a monopoly starts to fail, the reflexive approach is to demand yet more monopolies in an attempt to shore it up. And the faster people point out why that won't solve the problem, the faster the demands come for even more oppressive and unreasonable legislation to try to head off those issues.

And make no mistake: if Germany adopts this approach, there will be squeals from publishers around the world demanding "parity", just as there have been with the term of copyright. And so the ratchet will be turned once more.

The Battle for Scholarly Publishing's Soul

Before Peter Suber became Mr Open Access, he was a philosopher by trade. This is evident in the long, thoughtful essays he writes for the SPARC Open Access Newsletter, which help console us for his absence these days from the world of blogging.

Here's the latest of them, entitled "Open access, markets, and missions". It asks some deep questions about what kind of scholarly publishing we should strive for: market oriented or mission oriented? As he observes:

Profit maximizing limits access to knowledge, by limiting it to paying customers. If anyone thinks this is just a side-effect of today's market incentives, then we can put the situation differently: Profit maximizing doesn't always limit access to knowledge, but is always ready to do so if it pays better. This proposition has a darker corollary: Profit maximizing doesn't always favor untruth, but is always ready to do so if it would pay better. It's hard to find another explanation for the fake journals Elsevier made for Merck and the dishonest lobbying campaigns against OA policies. (Remember "Public access equals government censorship"? "If the other side is on the defensive, it doesn't matter if they can discredit your statements"?)

He concludes:

Instead of hypnotically granting the primacy of markets in all sectors, as if there were no exceptions, we should remember that many organizations compromise profits or relinquish revenues in order to foster their missions, and that we all benefit from their dedication. Which institutions and sectors ought to do so, and how should we protect and support them to pursue their missions? Instead of smothering these questions for offending the religion of markets, we should open them for wider discussion. Should scholarly publishing, with all of its mixed incentives and hard choices, migrate closer to market-oriented end of the spectrum or to the mission-oriented end of the spectrum? For me the answer depends on a prior question. Do we want scholarly publishing to serve a certain function in the community?

Media Vacuums Will Be Filled, Blogs Will Win

Great point here from Adam Tinworth, about why traditional publishers are suffering so badly at the hands of the bloggers:


the new breed of publisher - the ones doing it for pure passion, at virtually no cost - will and up wounding us where we're weakest. Because we've neglected parts of our audience, pandered to our own prejudices and missed opportunities.

*That* is why blogs have succeeded, and will continue to succeed until the gentlemen's club formerly known as publishing has an epiphany and sorts itself out.
