Saving the Intellectual Commons with Open Source

Regular readers of this blog will know that I am not a fan of the term “intellectual property”, and that I prefer the more technically correct term “intellectual monopolies”. Despite that, I strongly recommend a new book from someone who not only approves of the term “intellectual property”, but of its fundamental ideas. I do so, however, because this avowed fan also has serious reservations....

The History Commons

As someone who has been writing about the commons for many years, I am still amazed when new ones pop up. Here's another:

The History Commons website is an experiment in open-content civic journalism. It provides a space for people to conduct grassroots-level investigations on any issue, providing the public with a useful tool to conduct oversight of government and private sector entities. It is collaborative and thus allows individuals to build upon the work of others. Each investigation is organized as a “project,” which is made up of at least one timeline. You can contribute to a project by adding new events to the timeline associated with that project. All submissions are peer-reviewed by other users before being published. If you would like to participate in this effort, you will first need to create a user account. Once you have done that, you can begin adding events to any timeline.

It's Morphic Resonance All Over Again

Last week I was talking at the Open Everything meeting in London, where I went through some (most) of my tropes about openness and the creation of a commons, about enclosure (of land, creativity and ideas), how today's open movements are based on the economics of abundance, not scarcity, and are actually a return to a pre-lapsarian state, rather than something inherently new.

What was particularly heartening about the occasion was meeting so many other people with similar viewpoints, albeit coming from slightly different starting positions. Indeed, one of the most positive signs that something is afoot is the broad-based nature of this growing unanimity around the world.

For example, I came across a reference to the paper "Undermining abundance (Counter­productive uses of technology and law in nature, agriculture, and the information sector)", which also ties together the enclosure of many different domains:

Technology and law are increasingly used to undermine processes of abundance intrinsic to nature, agriculture and the information sector. A number of examples are reviewed here. Such counter­productive use of technology and law is traced to corporate profit­seeking. The relationships between the phenomenon of abundance and the related concepts of scarcity and commons are explored. Finally, approaches are proposed that harness abundance for the human good.

This led me to the blog of the author, Roberto Verzola. He's based in the Philippines, which has provided me with interesting insights into what's happening in that part of the world in terms of openness.

Here's a taster of his original thinking, from a posting provocatively entitled "The piracy of intellectuals":

We’ve seen people who come from or work for Western software firms. Well groomed, in business coat and tie, they look the antithesis of the pirate they hate so much. They come and visit this country of pirates, and perhaps make a little study how much they are losing from piracy in the Philippines.

Quite a number of them, however, come to the country to do some pirating themselves.

But they don’t pirate software, which is apparently beyond their dignity. They pirate people. They pirate those who write the software. They pirate our best systems analysts, our best engineers, our best programmers, and our best computer operators.

The advanced countries of the West routinely pirate from the Third World our best professionals and skilled workers, but begrudge us peoples of the Third World if we engaged in some piracy ourselves. They accuse the Third World of “piracy of intellectual property”, yet they themselves engage in the “piracy of intellectuals”.

In truth, there is quite a difference between pirating intellectual property and pirating intellectuals.

For example, it costs our country perhaps ten thousand dollars to train one doctor. Training a second doctor would cost another ten thousand dollars. Training ten doctors would cost a hundred thousand dollars. In short, given an ‘original’ doctor, it would cost us as much to make each ‘copy’ of the original. When the Americans pirate our doctors, they take away an irreplaceable resource, for it takes more than ten years to train a new doctor. The Philippines has approximately one doctor for every 6,700 citizens. When the U.S. pirates this doctor, it denies 6,700 Filipinos of the services of a doctor. And every year, the U.S. takes away hundreds of our doctors. How many Filipinos died because they could not get the services of a doctor on time?

What about a computer program? Whatever amount Lotus Corporation spent in developing their spreadsheet program, it costs practically nothing to make a second or third copy of the program. It would take a few seconds for them to make each copy. When we Filipinos pirate their program, we have not stolen any irreplaceable resource, nor will it take Lotus 10 years to replace the program, nor have we denied any American citizen the use of the spreadsheet program. It is still there, for Americans to use. We make a copy of their program, we don’t steal it, because we have not taken anything away. We have made our own copy, but they still have the original.

Pirating a computer program is quite different from pirating a doctor. When the U.S. pirates our doctors, it doesn’t take a copy and leave the original behind. Instead, it takes the original and leaves nothing behind.

Radio spectrum is inherently a commons, a resource that is owned by no one or by the state, but available to all. Too often in the past, that commons has been enclosed – sold off to the highest bidder. Now, it seems, some of the fences are being torn down, in the US at least....

Tragedy of the Fishy Commons

Fishing vessels on the Grand Banks of Newfoundland are this week destroying the best hope for years that the region's cod fishery, once the world's most abundant, might yet recover.

Faced with utter, selfish stupidity like this, I do sometimes think we deserve what is bubbling up through time towards us....

The Economist's New Commons Sense

Baby steps:

The economics of the new commons is still in its infancy. It is too soon to be confident about its hypotheses. But it may yet prove a useful way of thinking about problems, such as managing the internet, intellectual property or international pollution, on which policymakers need all the help they can get.

What's Wrong with this Picture?

Ignoring the parodistic language, that is:


Essentially, with the Internet, capitalism gifts the masses with a false commons where people can work, off the clock, creating information and relationships that the ruling class can enclose, appropriate, commodify, and sell back to us at a later date. It’s a way of letting the process of primitive accumulation work as a perpetual, and because of the stagnation of the economies in the advanced capitalist countries, vital, supplement to the mechanism of exploitation, and one that should be seen alongside the other forms of primitive accumulation that are occurring right now and are, for sure, much more important: the direct seizure of Iraqi resources, the copyrighting and commodifying of the material of our bodies, and most obviously, the accumulation by dispossession that is occurring in Africa, in China, in Latin America, as capitalism pushes to its limits and attempts to expunge from the earth any trace of commonly-held land.

What's wrong with it? Well, centrally, it looks at things purely in monetary terms: that everything has a price, and that everything has to be paid for. In many ways, the central insight of commons-based activities is that there are things of worth beyond money, things that capitalism really can't capture (luckily).

Or as Michel Bauwens puts it in his own reply in the same post:

The last thing we want and need to do is the be so mentally colonized by the logic of market exchange that all we can and want to ask is just for a bigger piece of the pie. The key question is: how can we both preserve the social achievements of participation and peer production, and make a living at the same time. Out of the answers to this question will come the new social forms.

Why Dear Trees Really Are Dear

A year ago, I wrote about the plight of urban trees. At the time, I never imagined we'd have a solution as far-sighted as this:

A plane tree in central London has been valued at £750,000 under a new system that puts a "price" on trees. How?

A six-foot-wide plane in Berkeley Square, Mayfair, is thought to be the UK's most valuable tree.

Large, mature, city trees like this one are being blamed - sometimes wrongly and often fatally - for damage to neighbouring properties.

But it is hoped a new valuation system will make it harder for "expensive" trees to be felled due to doubtful suspicions they are to blame for subsidence.

...

Putting a price on a tree changes people's attitudes and if developers think in financial terms, then a community asset must be valued in the same currency, he says.

So if a developer is in court for illegally destroying a tree, then the fine could be a reflection of the tree's value, says Mr Stokes. Or if a new development replaces a stock of trees then the builder could contribute to the community a sum equal to the value of that lost stock.

Brilliant. Now, if we could only apply that to all the rest - air, water, animals, plants....

Open Source Jahrbuch 2008

No good deed goes unpunished, they say.

A year ago, I wrote the following about the Open Source Jahrbuch series:

All-in-all, I'd go so far as to say that this is the best book on open source that has been published in the few years or so. Taken together, the whole series of Yearbooks form perhaps the most important collection of writings on open source and related areas to be found in any language.

As a result of those rash words, I was asked whether I'd like to contribute to this year's tome, which, as ever, is freely available as a download. If you want to practise your German, my 'umble effort is on page 299 (they obviously believe in saving the best for last....)

It begins thus:

Stallman's Golden Rule and the Digital Commons

In the wake of the high-profile successes of free software, the related movements of open access, open data, open content and the rest are starting to impinge on the public's consciousness. But when they do, they are generally seen as simple applications of the ideas behind free software – in other words, as imitations, albeit interesting ones. This misses the bigger picture: that, together, the combined results of their efforts form a vast and unprecedented digital commons of knowledge. The main obstacles to expanding that commons yet further are now legal, rather than technical. They are the result of political lobbying by content industries that have failed to adapt their thinking to a digital, rather than an analogue, world. The emerging viability of open source companies, which share their software freely with customers, points the way to new kinds of business models based on embracing rather than enclosing the commons.

The Most Important Fish You've Never Heard Of

The Menhaden:

The only remaining significant checks on the phytoplankton that cause algal blooms and dead zones are those menhaden schools, and they are now threatened by the ravages of unrestrained industrial fishing. By the end of the twentieth century, the population and range of Atlantic menhaden had virtually collapsed. The estimated number of sexually mature adult fish had crashed to less than 13 percent of what it had been four decades earlier. Although northern New England had once been the scene of the largest menhaden fishery, adult fish had not been sighted north of Cape Cod since 1993.

Marine biologist Sara Gottlieb, author of a groundbreaking study on menhaden's filtering capability, compares their role with the human liver's: "Just as your body needs its liver to filter out toxins, ecosystems also need those natural filters." Overfishing menhaden, she says, "is just like removing your liver."

If a healthy person needs a fully functioning liver, consider someone whose body is subjected to unusual amounts of toxins -- just like our Atlantic and Gulf coasts. If menhaden are the liver of these waters, should we continue to allow huge chunks to be cut out each year, cooked into industrial oils, and ground up to be fed to chickens, pigs, and pets? Menhaden have managed to survive centuries of relentless natural and human predation. But now there are ominous signs that we may have pushed our most important fish to the brink of an ecological catastrophe.

Menhaden are therefore a commons - something owned by all, and in this case, needed by all. Just for a change, human greed is destroying that commons. And once again, there will be a heavy price to pay.

How Do You Say "Commons" in Chinese?

One of the key themes of this blog is the idea of a commons, be it one constructed out of free software, open content or DNA. But as the very word suggests, there is a very specific history behind the concept, which raises an interesting question: how relevant is it in other cultures? Is it even meaningful if there is no corresponding equivalent?

Here are some interesting thoughts on the situation in China:

Lawrence Liang, a lawyer of Chinese descent from Bangalore, gave a brilliant talk (I'm told all his talks are brilliant - this was the first time I've heard him speak) titled "How Does An Asian Commons Mean." No, that's not a typo. He points out that "the metaphor of the commons as it is used in debates on information emerges from a specific history of the enclosures movement in Europe." The task of articulating an Asian Commons requires more than merely translating existing initiatives such as Creative Commons, but rather "to answer larger questions of what it means to provide an epistemological account of the commons in Asia." This is especially challenging because the idea that one can consider oneself "Asian" and that such a label has real cultural or social meaning "is a "diplomatic fiction... neither Asia nor commons has any substantive content."

Fascinating stuff.

Magna Carta and the Commons

Here's an old but wonderful essay drawing out the many connections between the Magna Carta and the commons. Its sweep is broad:

While the Magna Carta is singular, an English peculiarity, its story is one of oppression, rebellion, and betrayal. It has become a story with global significance. We are commoners looking in at it from the outside. We have seen its history from the robber barons who became chivalric knights who became law lords who became “founding fathers.” Having studied their doings in the forest, in Palestine, in the law court, on the frontier, and now in Iraq, we have learned to be suspicious.

Here's a good example of how crowdsourcing can enhance a commons:

The key goals of this pilot project are to firstly give you a taste of the hidden treasures in the huge Library of Congress collection, and secondly to show how your input of a tag or two can make the collection even richer.

It's an obvious approach to take, and one that could be widened to any public resource.

The Real Big Switch

An eloquent statement by John Wilbanks about the commons, sharing and solving complex problems:

One of the reasons I believe so deeply in the commons approach (by which i mean: contractually constructed regimes that tilt the field towards sharing and reuse, technological enablements that make public knowledge easy to find and use, and default policy rules that create incentives to share and reuse) is that I think it is one of the only non-miraculous ways to defeat complexity. If we can get more people working on individual issues – which are each alone not so complex – and the outputs of research snap together, and smart people can work on the compiled output as well – then it stands to reason that the odds of meaningful discoveries increase in spite of overall systemic complexity.

He concludes:

It is not easy. But it is, in a way, a very simple change. It just requires the flipping of a switch, from a default rule of “sharing doesn’t matter” to one of “sharing matters enormously”.

That's what it's all about, people.

De-Commodifying an Enclosed Commons

Confused? You will be:

in today’s world, the crush of branded meanings has become overwhelming. The cultural space is too cluttered with signifiers, and words are losing their credibility. And marketing itself is so ubiquitous that it is difficult for a super-elite establishment to convey that it is “above it all” -- grandly indifferent to the market. Clearly the next step is to de-commodify the product or service that was sold in the market, and previously belonged to the commons, and make it a proprietary gift! Ah, now that’s really luxury!

Building the Zotero Commons

One of the many insights that have come out of open source is what might be called the "pebble on the cairn" effect - the idea that by combining the small, even negligible, individual efforts we can create something large and durable.

Here's a perfect example that builds on the fact that scholars very often scan books in the public domain during the course of their research, but then don't do anything with those scans. What if they were all brought together, and then fed into an OCR system?

If many researchers have had to scan rare documents or books for their own perusal, there’s a potential treasure trove of material that exists among their combined efforts. Rather than let all that scholarship rot, or waste away in data files, the university’s Center for History and New Media sees an opportunity to create an open archive of scholarly resources in the public domain.

...

In partnership with the Internet Archive, and with funding from the Andrew W. Mellon Foundation, the center is creating a way for scholars to upload existing data files to be optically scanned (to make them text-searchable) and stored in a database available to the public.

Even better is that fact that open source software can be used to make realise this idea:

The vehicle for the new environment will be the Zotero plug-in for the Firebox browser, also developed by the center. The software stores Web pages, collects citations and lets scholars annotate and organize online documents. A new feature of the plug-in will allow people to collaborate and share materials through a dedicated server. Building on that functionality, according to Cohen, the system will allow scholars to drag and drop documents onto an icon in Zotero that essentially sends it to the Internet Archive for storage and free optical character recognition.

The eventual result of the project, called Zotero Commons, could be reduced need need for research trips, Cohen suggested.

Eben on Software Ecology

Eben Moglen is probably the most fluent and engaging speaker it has ever been my privilege to interview; proof of his enduring appeal can be found in the fact that I don't get tired reading yet more interviews with him, like this one, which includes the following suggestive passage:

One of the things that everybody now understands is that you can treat software as a renewable, natural resource. You can treat software like forest products or fish in the sea. If you build community, if you make broadly accessible the ability to create, then you can use your limited resources not on the creation or maintenance of anything, but on the editing of that which is already created elsewhere. We package them for your advantage, things you didn't have to make because you were given them by the bounty of nature.

And this one, too:

If you've become dependent on a commons, for whatever role in your business, then what you need is commons management. You don't strip mine the forest, you don't fish every fish out of the sea. And, in particular, you become interested in conservation and equality. You want the fish to remain in the sea and you don't want anybody else overfishing. So you get interested in how the fisheries are protected. What I do is to train forest rangers ... to work in a forest that some people love because it's free and other people love because it produces great trees cheaply. But both sides want the forest to exist pristine and undesecrated by greedy behavior by anybody else. Nobody wants to see the thing burn down for one group's profit. Everybody needs it. So whether you are IBM, which has one strategy about the commoditization of software, or you're Hewlett-Packard, which has another, whatever your particular relationship to that reality is, everybody's beginning to get it. In the 21st century economy, it isn't factories and it isn't people that make things -- it's communities.

The beauty of all this analysis is that the ideas flow both ways: if free software is a commons like the forests or the seas, then it follows that the forest and the seas share many characteristics of free software. Which is why you read about them all the time on this blog. (Via Linux Today.)

Why I (Heart) Trees

I've expressed my undying love for trees before, particularly as a way of preserving our atmospheric commons, but I had no idea that they were this good:

'Every year, the expanding European forests remove a surprisingly large amount of carbon from the atmosphere,' the study's co-author Aapo Rautiainen stresses. 'According to rough estimates, their impact in reducing atmospheric carbon may well be twice that achieved by the use of renewable energy in Europe today.'

So what's the obvious lesson to learn from this? Why, that they should be included in calculations of carbon sinks - and that countries who plant more trees/don't cut down the ones they have should be rewarded in terms of carbon credits:

Under the Kyoto Protocol, countries currently do not get emission credits for increasing natural carbon sinks through forestry and agriculture. The Finnish researcher's suggest, however, that this might be a helpful tool. 'Policies that accelerate the expansion of our forest biomass not only represent a win-win for climate change and biodiversity, they also open up economic opportunities,' states Laura Saikku, the third author of the study. 'Land owners can benefit with new industries like forest-based bio-energy production. This could also help to reduce one of the main threats to sustained forest expansion - the need to open land to produce agricultural biofuels as alternatives to fossil fuels.'

Obvious, really.
